Terms of Service

Terms of Service

Effective date: October 5, 2026

These Terms of Service (“Terms”) apply to your use of theboostology.com (the “Site”) and to the services Boostology (“Boostology,” “we,” “us,” or “our”) provides to clients. By using the Site, or by accepting a quote, proposal or invoice from us, you agree to these Terms. If you are agreeing on behalf of a company, you confirm that you have authority to bind that company, and “you” or “client” means that company.

If you have questions, email info@theboostology.com.

1. About Boostology

Boostology is a website design, development and digital marketing agency led by Hamza Zaheer (CEO) and Nusrat Bashir (Co-Founder). Our mailing address is 9558 112th Street, South Richmond Hill, NY 11419, USA. Our team works remotely, and we work with clients in the United States and other countries.

2. Our services

We offer:

  • Website design and development, specializing in Webflow, and also WordPress
  • SEO (search engine optimization) and content writing
  • Guest posting and link building
  • Social media marketing
  • Meta (Facebook and Instagram) advertising
  • Graphic design and branding

The exact work for each project, including deliverables, timeline, price and number of revisions, is set out in a written quote, proposal, statement of work or invoice that you accept (a “Proposal”). If a Proposal and these Terms conflict, the Proposal wins for that project. If you hire us through a freelance marketplace such as Upwork, that platform’s terms on payment, refunds and disputes apply and take priority where they conflict with these Terms.

We may use trusted team members and contractors to help deliver the work. We remain responsible for their work under these Terms. We may also use AI tools to help with research, drafts and design; a person on our team reviews all work before we deliver it. If you do not want AI tools used on your project, tell us before work begins and we will note it in the Proposal.

3. Quotes and proposals

  • Prices shown on the Site are starting prices. We prepare a written quote or Proposal for each client based on the scope you describe, and the Proposal price is the one that applies.
  • Unless the Proposal says otherwise, a quote is valid for 30 days from the date we send it.
  • A quote is based on the information you give us. If the scope changes, or the information turns out to be different (for example, more pages, more products, or a more complex integration than described), we will tell you and send an updated quote before doing the extra work.
  • A Proposal becomes binding when you accept it in writing (including by email or by signing), or when you pay the deposit or first invoice.
  • Our free website audit is a free, no-obligation review based on publicly available information. It is general guidance, not a guarantee of results, and it does not create a client relationship.

4. Payment terms

  • Currency: all prices are in US dollars (USD) unless the Proposal says otherwise.
  • Invoices: we bill by invoice. Payment methods are listed on each invoice.
  • Project work (such as websites, branding and design): we ask for a deposit (the percentage is stated in your quote) before work begins. The remaining balance is due before final files are handed over, the site is launched, or ownership is transferred, unless the Proposal sets out a different milestone schedule.
  • Monthly services (such as SEO, content, social media management, link building and ads management): billed in advance at the start of each month, unless the Proposal says otherwise.
  • Due date: invoices are due within 7 days of the invoice date unless the invoice states a different date.
  • Late payment: if an invoice is more than 14 days overdue, we may pause work, pause scheduled posts or campaigns we manage, and hold deliverables until the account is paid. We will email you before we pause anything. Pausing work may delay your timeline.
  • Taxes and fees: prices do not include sales taxes or similar taxes unless stated. You are responsible for any bank, transfer or payment processing fees on your side.
  • Third-party costs: unless the Proposal says they are included, you pay for third-party costs directly, such as Webflow site plans, hosting, domains, premium themes and plugins, fonts, stock images, software subscriptions, publisher fees for guest posts, and advertising spend (see Section 9).
  • Deposits and refunds: the deposit reserves our time and covers early work, so it is non-refundable once work has started. Payments for work already completed are non-refundable. If we cancel a project before starting work, we will refund any deposit paid for that project.
  • Disputes: if you think an invoice is wrong, please tell us within 7 days of receiving it. We will work with you in good faith to fix it, and you agree to pay any part of the invoice that is not in dispute on time.

5. Timelines

Timelines in a Proposal are good-faith estimates. They depend on you providing content, feedback, approvals and access on time. If we are waiting on you, the timeline moves by at least the same amount of time. If a project is on hold for more than 30 days because we are waiting on you, we may treat it as paused, invoice for the work completed so far, and agree a new start date with you when you are ready.

6. Revisions and changes

  • Each Proposal states how many rounds of revisions are included. If it does not say, two rounds of revisions are included for each main deliverable (for example, the homepage design, a logo concept or a piece of content).
  • A round of revisions means one consolidated list of feedback, sent together, on the current version of a deliverable. Please gather feedback from everyone on your side before sending it.
  • Revisions cover changes within the agreed scope. New pages, new features, a new design direction, or work outside the Proposal are change requests. We will quote change requests before doing them, at the rate in the Proposal or a new quote.
  • Once you approve a stage (such as a design before development starts), changes to that approved stage may be billed as extra work.
  • If you do not respond to a delivered item within 14 days, we may treat it as approved so the project can move forward. We will remind you before we do this.

7. Your responsibilities as a client

To help the project succeed, you agree to:

  • Give us accurate information, and the content, brand assets, feedback and approvals we need, on time
  • Provide the access we need to your platforms (such as Webflow, WordPress, hosting, domain registrar, Google Analytics, Google Search Console, Google Business Profile and Meta Business Suite). Where possible, add us as a user with our own login instead of sharing your main password, and remove our access when the work ends.
  • Make sure you own or have permission to use everything you send us (text, images, logos, videos, fonts, product data and customer lists), and that using it will not break anyone else’s rights or any law
  • Review and approve content, ads and pages before they go live. You are responsible for the accuracy of claims about your products and services, including any pricing, health, financial, legal or before-and-after claims.
  • Comply with the laws and platform rules that apply to your business and your marketing, including privacy and consent rules for your own website and ads (for example, having a privacy policy and cookie consent where required, and having the right to upload any customer list used to build ad audiences)
  • Keep your own backups of your website and content. We take reasonable care, but you are responsible for maintaining backups unless backups are part of a service you pay us for.
  • Pay invoices on time
  • Treat our team with respect. We may end a project if a client is abusive or asks us to do something illegal or unethical.

8. Intellectual property

  • Your materials: you keep ownership of everything you give us, such as your logo, content, photos and data. You give us permission to use these materials only to provide the services.
  • Transfer on full payment: when you have paid all amounts due for a project in full, we transfer to you ownership of the final deliverables we created specifically for you under that Proposal (for example, your final website design, final logo files and the final written content we delivered). Until full payment, we own the deliverables, and you have a limited permission to review them for the project only.
  • Our tools and know-how: we keep ownership of our pre-existing materials and general know-how, such as code snippets, components, frameworks, templates, processes and methods that we use across many projects. Where these are part of your deliverables, we give you a permanent, non-exclusive, royalty-free license to use them as part of your project once you have paid in full.
  • Concepts not chosen: drafts, unused concepts and alternative designs that you did not select stay our property, unless the Proposal says otherwise.
  • Third-party materials: some deliverables include items made by others, such as Webflow or WordPress themes and templates, plugins, fonts, stock photos, icons and software. These remain owned by their creators and are used under their own licenses. You agree to follow those licenses and, where needed, keep any required subscriptions active in your name.
  • Portfolio: we may show the work we did for you in our portfolio, on the Site, on social media, and in proposals to other prospects, and we may name you as a client. We will not share confidential information (such as private data, internal numbers or unreleased products) this way without your permission. If you do not want us to show your work, or want us to wait until a public launch date, tell us in writing (email is fine) and we will respect that.

9. Third-party platforms and ad spend

Much of our work runs on platforms we do not own or control, such as Webflow, WordPress and its plugins, hosting companies, Google (including Google Search, Google Analytics, Google Search Console and Google Business Profile), and Meta (Facebook and Instagram).

  • Platform terms: your use of these platforms is governed by their own terms and policies. Accounts should be set up in your name, or transferred to you, so you keep control of them.
  • Platform fees: you pay platform subscription fees (such as Webflow site plans or hosting) directly, unless the Proposal says we will bill them to you.
  • Ad spend: for Meta ads and any other paid advertising, the advertising budget (“ad spend”) is paid by you directly to the platform, using a payment method in your own ad account. Ad spend is separate from, and in addition to, our management fees. We are not responsible for charges made by the platform to your payment method, but we will run campaigns within the budget you approve.
  • Changes and outages: platforms can change their features, prices, policies and algorithms, have outages, or reject, limit or suspend ads, pages or accounts. We are not responsible for these decisions or their effects. We will follow platform rules in good faith and help you respond if something happens, but we cannot guarantee that a platform will approve an ad or reinstate an account.
  • Guest posting and link building: placements are on third-party websites we do not control. Publishers may edit, move or remove content or links over time, and some publishers charge fees. Google’s spam policies discourage links bought to manipulate rankings, so we focus on relevant, editorial placements, and search engines can change how they treat any link at any time. Any replacement policy for removed links will be stated in the Proposal.

10. No guaranteed results

We work hard to get you good results, but many factors are outside our control, including search engine algorithms, competitors, platform decisions, your industry, your budget, and how your market responds. For this reason:

  • We do not guarantee any specific search engine ranking, position, traffic level, number of leads, sales, followers, engagement, cost per result or return on ad spend.
  • Any estimates, forecasts or examples of past results we share are for illustration only and are not a promise of future results.
  • SEO usually takes months to show results, and results can go up and down over time.

Except as clearly stated in these Terms or a Proposal, the Site and our services are provided “as is,” and we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the extent the law allows. We do warrant that we will perform our services in a professional and workmanlike manner. If you tell us about a defect in our own work (such as a bug in code we wrote) within 30 days of delivery or launch, we will fix it at no extra charge.

11. Confidentiality

Each of us may share confidential information with the other, such as business plans, pricing, customer data, login details, unreleased products and financial information. Each of us agrees to:

  • Use the other’s confidential information only for the project
  • Not share it with anyone except team members, contractors and advisers who need it for the project and are bound by confidentiality obligations
  • Protect it with reasonable care

This does not apply to information that is already public through no fault of the receiving party, that the receiving party already knew or developed independently, or that it received lawfully from someone else. Either of us may disclose confidential information if required by law, after giving the other notice where allowed. These obligations continue for 3 years after our work together ends, and for as long as the information remains a trade secret or personal data. We are happy to sign a separate non-disclosure agreement if you need one.

Where we handle personal information on your behalf (for example, form entries on your website or customer lists in your ad account), we will use it only to provide the services and will handle it as described in our Privacy Policy. We can provide a data processing agreement on request.

12. Limitation of liability

To the fullest extent allowed by law:

  • Neither of us is liable to the other for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data or loss of business opportunity, even if told they were possible.
  • Our total liability for any claim relating to the Site, these Terms or our services is limited to the amount you paid us under the Proposal that the claim relates to during the 12 months before the event giving rise to the claim.
  • We are not liable for losses caused by third-party platforms, hosting providers, plugins, ad platforms, publishers, or by your own content, instructions, delays or failure to keep backups.

These limits do not apply to your obligation to pay invoices, to either party’s indemnity obligations below, or to liability that cannot be limited by law (such as for fraud or willful misconduct).

13. Indemnity

You agree to defend and indemnify Boostology against third-party claims, and related losses and reasonable legal fees, that arise from the materials you provide, the claims made in your ads or content that you approved, your products or services, or your breach of these Terms or the law.

We agree to defend and indemnify you against third-party claims, and related losses and reasonable legal fees, that arise from a claim that original work we created for you (not including your materials or third-party materials) infringes someone else’s copyright.

The party asking for indemnity must tell the other party promptly about the claim and cooperate reasonably in the defense.

14. Term and termination

  • Projects: a project Proposal stays in effect until the work is completed and paid for, unless ended earlier under this section.
  • Monthly services: monthly services continue month to month (after any minimum term in the Proposal) until either of us gives 30 days’ written notice to cancel. Email is fine.
  • Ending for cause: either of us may end a Proposal by written notice if the other seriously breaches these Terms and does not fix the breach within 14 days after notice. We may also end a Proposal if invoices remain unpaid for more than 30 days.
  • Ending a project early: you may end a project at any time by written notice. If you do, you pay for all work completed up to the end date (based on the Proposal or our rate for the time spent) and any non-cancellable third-party costs we have committed to for you. The deposit is non-refundable once work has started.
  • What happens at the end: once all amounts due are paid, we hand over the deliverables completed so far, and ownership transfers as described in Section 8. We will help you take control of any accounts we managed for you. Please remove our access to your platforms; we will stop using any credentials you gave us.
  • Sections that continue: Sections 4 (amounts owed), 8, 10, 11, 12, 13, 16 and 17 continue after these Terms or a Proposal end.

15. Use of the Site

When you use the Site, you agree not to misuse it. This means you will not try to hack, overload or disrupt the Site, scrape it in bulk, send spam or malicious code through our forms, or use the Site for anything illegal. The content on the Site, including text, graphics, logos and portfolio images, is owned by Boostology or its clients and licensors and may not be copied for commercial use without permission. Information on the Site is general information about our services, not professional advice for your specific situation. Our Privacy Policy explains how we handle personal information collected through the Site.

16. Governing law and disputes

These Terms, and any dispute about them, the Site or our services, are governed by the laws of the State of New York, USA, without regard to its conflict of laws rules.

If a dispute comes up, please email us first at info@theboostology.com. We will try in good faith to resolve it informally within 30 days. If we cannot, the dispute will be decided exclusively in the state or federal courts located in New York, and both of us agree to the jurisdiction of those courts. Either of us may still bring a claim in small claims court if it qualifies. If you hired us through a marketplace such as Upwork, you may also use that platform’s dispute process.

17. General terms

  • Entire agreement: these Terms and any Proposal you accept are the full agreement between us about the services, and replace earlier discussions on the same subject.
  • Independent contractors: we are independent contractors. Nothing in these Terms creates an employment, partnership or joint venture relationship.
  • Force majeure: neither of us is responsible for delays caused by events beyond reasonable control, such as natural disasters, power or internet outages, platform outages, illness, war or government action. This does not excuse payment of amounts already owed.
  • Assignment: neither of us may transfer these Terms to someone else without the other’s written consent, except that either of us may transfer them as part of a merger or sale of the business.
  • Notices: notices under these Terms can be given by email to the address each of us uses for the project, or for Boostology, to info@theboostology.com.
  • Severability: if any part of these Terms is found unenforceable, the rest stays in effect.
  • No waiver: if either of us does not enforce a right immediately, that does not mean the right is given up.
  • Changes to these Terms: we may update these Terms from time to time and will change the effective date at the top. Changes do not affect a Proposal you have already accepted unless you agree in writing.
